1. Introduction

We, Wosa-Wosa Lapa CC, registration number CK 99 64487 / 23 is a Closed Corporation registered In South Africa in accordance with the Closed Corporations Act. We supply our clients with tailor made itineraries for travel purposes. If you want to make use of our services, you indicate to us what package you choose and you provide us with the completed questionnaire that we have designed for you and with your credit card particulars. By submitting your credit card particulars, or after agreed payment was made into the Wosa-Wosa Lapa bank account, you offer to contract with us on the terms set out herein. We shall send you an e-mail message advising you of our acceptance of your offer.

2. Ownership

This site is owned by Wosa-Wosa Lapa and it has copyright with regard to the contents of this site. The contents may not be reproduced, sold, transferred or modified without the prior written permission of Wosa-Wosa Lapa.

3. Age

You represent that you are 21 years of age, or alternatively that you are at least 16 years of age and that your guardian has agreed to you entering into this agreement. You understand that you incur financial obligations when you make use of our services.

4. Privacy

If you require us to make bookings on your behalf, we may provide information about you the hotel or other involved third party. Except for the purpose of bookings, we do not disclose information about our clients to third parties.

5. Limitation of liability

We take reasonable care to ensure that tour operators and guides that we introduce to you are reliable. Tour operators and guides, however remain independent contractors and we do not guarantee that a specific operator or person will be available on the day required.

Likewise, we take reasonable care that accommodation, vehicles, sport and other facilities are in accordance with the standard that you require. Providers of these facilities, however remain independent contractors and we do not guarantee that the facilities will be available or that they will meet the standards that you require.

Except as stated above, Wosa-Wosa Lapa, its members and employees will not be liable for any loss, damage or injury that you may suffer as a result of your usage of this site or as a result of your reliance on an itinerary prepared by us.

6. Assignment

You may not assign, cede or delegate any of your rights or duties hereunder.

7. Governing law

This agreement shall be governed and construed in accordance with the laws of South Africa.

8. Disputes

Any dispute arising from or in connection with this agreement shall be finally resolved in accordance with the Rules of the Arbitration Foundation of Southern Africa by an arbitrator or arbitrators appointed by the Foundation.

9. Entire contract, amendment and indulgences

This agreement constitutes the entire agreement between ourselves and no amendment hereof shall be valid unless agreed by e-mail or as set out below.

10. Communication

Communication with regard to this agreement shall be by e-mail, unless a party has in writing notified the other party of a physical address for purposes of correspondence.
